Business associations have developed draft laws proposing amendments to the Customs and Tax Codes concerning the taxation of imported parcels. Specifically, it is suggested to impose VAT on all parcels from foreign marketplaces, reported the head of the parliamentary committee on finance, tax, and customs policy, Daniil Hetmantsev.
"Based on business requirements, I submitted draft laws for the registration of parcel import taxation. The texts of these draft amendments to the Customs and Tax Codes have been fully developed by the relevant business associations," he wrote on his Telegram channel.
Thus, the draft laws propose not to impose VAT on goods valued up to 45 euros, provided these parcels are sent to individuals without payment and for non-commercial purposes. At the same time, goods purchased on marketplaces and similar platforms will be subject to VAT regardless of their value. Import duties will only be levied on items costing more than 150 euros.
The documents also foresee the introduction of the option for VAT payment directly by the suppliers of goods or marketplaces, similar to the European IOSS mechanism.
"VAT payment by the supplier of the goods or the marketplace will eliminate the need for additional payments from the buyer during customs clearance and will help expedite customs procedures," Hetmantsev noted.
The draft law provides for the introduction of a new customs declaration for low-value goods, which will include data similar to the H7 customs declaration used in EU countries. Meanwhile, the current forms for declaration will still be applicable.
These measures are proposed to simplify VAT administration and speed up the parcel processing at customs, the committee head stated.
According to him, the regulation of taxation has been supported by the American Chamber of Commerce, the European Business Association, the Federation of Employers of Ukraine, the Association of Information Technology Enterprises, the Ukrainian Business Council, the Retailers Association, and the Chamber of Commerce and Industry of Ukraine.
As reported, Taras Panasenko, co-founder and CEO of the "Avrora" network, criticized the strategic partnership project between "Ukrposhta" and the Chinese marketplace Temu, calling for equal taxation rules for foreign and Ukrainian e-commerce businesses.
